Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you,” “your,” or “User”) and E Mini Maverick (“we,” “us,” “our,” or “Company”), governing your access to and use of the eminimaverick.com website and all related services, including but not limited to our live Zoom trading room, Telegram chat group, Copilot trade signal service, EB Indicator for TradingView, Gamma Boss gamma analysis channel, educational eBook, and any other content or tools we provide (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.

1. Nature of Services

1.1 Educational Purpose Only

All Services provided by E Mini Maverick are strictly for educational and informational purposes. Our live trading room, trade signals, indicators, analysis, and all related content are intended to teach trading concepts and share market observations. Nothing we provide constitutes investment advice, financial advice, tax advice, or trading recommendations personalized to your individual situation.

1.2 What We Are

E Mini Maverick is a live futures trading room and educational community. Join Maverick and other likeminded traders as they come together daily to observe, discuss, and interact throughout the trading session. Our services include live market commentary, trade signals via our Copilot system, proprietary indicators, and educational resources. While we provide trade signals, all trading decisions are ultimately yours.

1.3 Not a Registered Advisor

E Mini Maverick is NOT a registered investment advisor, broker dealer, or commodity trading advisor (CTA). We are NOT registered with the National Futures Association (NFA) or the Commodity Futures Trading Commission (CFTC). We do not manage client funds, execute trades on your behalf, or provide personalized investment recommendations.

1.4 Your Responsibility

All trading decisions are yours alone. You are solely responsible for evaluating the merits and risks of any trade you make. You should consult with a qualified, licensed financial advisor before making any trading or investment decisions.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use our Services. By using our Services, you represent and warrant that you meet these requirements. Futures trading may not be suitable for all individuals; you should carefully consider whether trading is appropriate for your financial situation.

3. Subscriptions and Payment

3.1 Payment Processing

All payments for our Services are processed through Whop.com, a third party payment platform. By subscribing, you agree to Whop’s terms of service and payment policies in addition to these Terms. We do not directly collect, store, or process credit card or payment card information.

3.2 Subscription Terms

Our Services are offered on a subscription basis. Pricing, billing intervals, and available plans are displayed on our Whop.com storefront or website at the time of purchase. We reserve the right to modify pricing at any time; changes will not affect your current billing cycle.

3.3 Free Trial

We may offer a free trial period for certain Services. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends.

3.4 No Refunds

All subscription payments are nonrefundable. Because our Services provide immediate access to live educational content, trade signals, and proprietary tools, refunds are not available once payment is processed. You may cancel your subscription at any time through Whop.com to prevent future charges, but no partial or prorated refunds will be issued for the remaining subscription period.

4. User Conduct

You agree to use our Services in accordance with these Terms and all applicable laws. You shall NOT:

Redistribute, resell, share, or publicly display any of our content, signals, indicators, recordings, or materials without our express written permission
Share your account login or access credentials with any third party
Record, screenshot, or redistribute live trading room sessions without authorization
Use our Services for any unlawful or unauthorized purpose
Disrupt, interfere with, or abuse any aspect of our Services or other users’ experience
Harass, threaten, or demean other participants in our trading room or chat groups
Reverse engineer, decompile, or attempt to extract the source code of our proprietary indicators or tools
Use bots, scrapers, or automated tools to access our Services without authorization
Impersonate E Mini Maverick, its operators, or any other user

5. Account Termination

We reserve the right to suspend or terminate your access to any or all of our Services, at our sole discretion, with or without notice, for any reason, including but not limited to:

Violation of these Terms or any applicable law
Sharing or redistributing proprietary content
Sharing account credentials with third parties
Disruptive, abusive, or harmful behavior
Failure to pay subscription fees

Upon termination, your right to access the Services ceases immediately. No refund will be issued for termination due to a violation of these Terms.

6. Intellectual Property

6.1 Ownership

All content, materials, software, indicators, signals, analysis, recordings, educational materials, the EB Indicator, trade signals, the “Funded Futures Trading” eBook, and all other intellectual property associated with our Services are the exclusive property of E Mini Maverick and are protected by copyright, trademark, trade secret, and other intellectual property laws.

6.2 Limited License

Your subscription grants you a limited, nonexclusive, nontransferable, revocable license to access and use our Services for your personal, noncommercial educational purposes only. This license does not include the right to modify, reproduce, distribute, publicly display, create derivative works from, or commercially exploit any of our content or tools.

6.3 TradingView Indicator

The EB Indicator is provided as a proprietary tool for use within the TradingView platform. Access to the indicator is tied to your active subscription. You may not copy, decompile, reverse engineer, or distribute the indicator code. Your license to use the indicator terminates immediately upon cancellation or termination of your subscription.

7. Risk Disclosure

7.1 Futures Trading Risk

Futures trading involves substantial risk of loss and is not suitable for all investors. You may lose more than your initial investment. The high degree of leverage available in futures trading can work against you as well as for you. Before trading futures, you should carefully consider your financial objectives, level of experience, and risk tolerance. You should be aware that you could sustain a total loss of your initial margin funds and any additional funds deposited with your broker to maintain your position.

7.2 No Guaranteed Profits

There is no guarantee that you will make money using our Services. Past performance of any trading system, methodology, indicator, or signal is not necessarily indicative of future results. No representation is being made that any account will or is likely to achieve profits or losses similar to those discussed or shown in our educational content.

7.3 Past Performance Disclaimer

Any trading results, account screenshots, profit/loss statements, or performance figures presented in our Services, website, social media, or marketing materials are provided for educational and illustrative purposes only. Individual results will vary. Past performance does not guarantee future results.

7.4 CFTC Rule 4.41: Hypothetical Performance Disclaimer

HYPOTHETICAL OR SIMULATED PERFORMANCE RESULTS HAVE CERTAIN LIMITATIONS. UNLIKE AN ACTUAL PERFORMANCE RECORD, SIMULATED RESULTS DO NOT REPRESENT ACTUAL TRADING. ALSO, SINCE THE TRADES HAVE NOT BEEN EXECUTED, THE RESULTS MAY HAVE UNDER OR OVER COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY. SIMULATED TRADING PROGRAMS IN GENERAL ARE ALSO SUBJECT TO THE FACT THAT THEY ARE DESIGNED WITH THE BENEFIT OF HINDSIGHT. 7.5 Live Trading Room Disclaimer

Our live Zoom trading room is an educational environment. Trades discussed, executed, or displayed during live sessions are for educational demonstration purposes only. They do not constitute recommendations to buy, sell, or hold any futures contract or financial instrument. You should not interpret any trade or statement made during a live session as personalized advice for your account. Every individual’s financial situation is different, and you must make your own independent trading decisions.

7.6 Copilot Trade Signals Disclaimer

Trade signals provided through our Copilot service are educational tools reflecting market observations. They are not personalized recommendations. Following any signal is entirely at your own risk. You acknowledge that signal timing, execution, slippage, and market conditions may cause your results to differ materially from any stated signal outcome.

8. Affiliate Disclosure

E Mini Maverick maintains affiliate relationships with third party companies, including but not limited to TakeProfit Trader, Apex Trader Funding, Bookmap, Flowbots/Replikanto, and NinjaTrader. When you click on affiliate links on our website or in our content and make a purchase or open an account, we may earn a commission at no additional cost to you.

Our affiliate relationships do not influence the educational content we provide. However, you should be aware of these financial relationships when evaluating our references to affiliate products or services. We only promote products and services we believe offer value, but we encourage you to conduct your own independent research before purchasing any third party product or service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, E MINI MAVERICK, ITS OWNERS, OPERATORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, TRADING LOSSES, DATA LOSS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE OUR SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO US IN SUBSCRIPTION FEES DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You expressly acknowledge and agree that we are not liable for any trading losses you may incur. All trading decisions and their consequences are your sole responsibility.

10. Indemnification

You agree to indemnify, defend, and hold harmless E Mini Maverick, its owners, operators, affiliates, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of our Services; (b) your trading activities; (c) your violation of these Terms; (d) your violation of any applicable law or regulation; or (e) your infringement of any third party rights.

11. Dispute Resolution

11.1 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, or validity thereof shall be resolved by binding arbitration administered in San Diego County, California, in accordance with the rules of the American Arbitration Association (AAA). The arbitration shall be conducted by a single arbitrator. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.2 Waiver of Class Action

You agree that any arbitration or legal proceeding shall be conducted on an individual basis only and not as a class action, consolidated action, or representative action. You waive any right to participate in a class action lawsuit or class wide arbitration against E Mini Maverick.

11.3 Informal Resolution

Before initiating arbitration, you agree to first contact us using the form below and attempt to resolve the dispute informally for at least 30 days.

12. Governing Law

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and E Mini Maverick regarding your use of our Services. These Terms supersede all prior agreements, understandings, and communications, whether oral or written, relating to the subject matter hereof.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of our Services after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
